These Terms of Use ("Terms") govern your access to and use of apartmentcashout.com (the "Site") and any related services we provide. By using the Site or contacting us, you agree to these Terms.

1. Who We Are

Apartment Cashout is a direct buyer of apartment and multifamily real estate operating nationwide from Texas. We are principals — we buy property for our own account, often together with a small group of investors we work with directly. We are not licensed real estate agents or brokers, we are not financial advisors, and we do not provide legal, tax, or investment advice. If you need advice in those areas, please consult a licensed professional.

2. No-Obligation Offers

When you submit our form, you are requesting a cash offer. Any cash offer we make is non-binding on either side until both you and we sign a written purchase agreement. You are under no obligation to accept any offer we make, and we are under no obligation to purchase any property. We may decline to make an offer for any reason or no reason.

3. Information You Provide

You agree that the information you provide to us — including property details, ownership status, occupancy, rent roll, liens, and mortgage information — is accurate to the best of your knowledge. We rely on this information when preparing an offer. If material facts change between your initial inquiry and closing, we may revise our offer accordingly.

4. Communications Consent

By submitting our form or otherwise contacting us, you consent to receive communications from us at the phone number, email address, or other contact information you provided. These communications may include autodialed calls, pre-recorded messages, and text messages about your property and inquiry. Standard message and data rates may apply. Consent to receive communications is not a condition of any purchase. You may opt out at any time by replying STOP to a text, asking us to remove you during a call, or emailing us at the address below.

5. Site Content; "As-Is"

The information on the Site is provided for general informational purposes and is offered on an "as-is" and "as-available" basis. We make no warranties, express or implied, regarding accuracy, completeness, reliability, fitness for a particular purpose, or non-infringement. Market conditions, comparable sales, and our offer calculations change over time and are not guaranteed.

6. Limitation of Liability

To the maximum extent permitted by law, Apartment Cashout and its owners and affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or any communication with us. Our total liability for any direct damages arising out of or related to the Site is limited to one hundred U.S. dollars (USD $100).

7. Intellectual Property

The Site, including its text, layout, and logos, is our property or used with permission and is protected by U.S. copyright and trademark laws. You may not copy, reproduce, or distribute Site content without our written permission, other than for personal, non-commercial use.

8. Third-Party Services

The Site relies on third-party services including Google (Maps and address autocomplete), FormSpree (form delivery), and Vercel (hosting). Their services are governed by their own terms; we are not responsible for their conduct.

9. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Site shall be brought in the state or federal courts located in Harris County, Texas, and you consent to the personal jurisdiction of those courts.

10. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Continued use of the Site after a change indicates your acceptance of the new Terms.
